Quebec has more late-term born-alive abortions than the rest of Canada

Andrea Mrozek writes about the recent study out of Quebec on born-alive abortions.

'The kicker for Canadians is that the study sample was 13,777 abortions done between 1989 and 2021 in Quebec. This means that over 32 years, about 430 abortions resulted in live births every single year in that province.'

These late term abortions also happen every year, in every other province in Canada. I have been collecting this data for many years from CIHI, but CIHI never reports on Quebec data. Now we know that there is an average of 430 of these late-term abortions in Quebec every year. This is a staggering number. It is also way higher than the number of late-term born-alive abortions in the rest of Canada (there were 131 in the rest of Canada in 2022/2023). 

Only 5.5% of these born alive abortions received palliative care.

'In analyses of live births, one-quarter of neonates (24.5%) were admitted to an intensive care unit and 5.5% received palliative care.'

Abort late-term baby. Abortion fails. Baby is born-alive. Don't give it palliative care. This is just plain evil.

CTV misleads Canadians on late-term born alive abortions

 "A popular, misleading claim about late-term abortions has made its way to the province."

This comes from the very first line of a CTV article about late-term abortions, live birth abortions in Alberta.

These children are born alive after a failed abortion. Then they die. Not propaganda.

The only misleading item here is this CTV story. There's nothing misleading about these born alive abortions. They happen. Every year. In Canada. In every province. Not just Alberta.

I have done extensive research on these abortions and they are performed in all provinces. My research goes back to 2012. But the media refuses to believe it apparently.

The stats come from the Canadian Institute for Health Information (CIHI). CIHI took over the publishing of abortion stats from Statistics Canada years ago when they didn't want their name associated with underreported abortion numbers that they were forced to publish. 

These abortions happen. Former MP Maurice Vellacott contacted the RCMP years ago about them and the RCMP refused to investigate.

It's time to stop these horrific abortions. Wake up Canada.

1,190 late term abortions in Canada for 2022/2023 (excluding Quebec)

Note: All the numbers reported exclude late-term abortions performed in Quebec.

Live birth late-term abortion numbers are down to 131 in 2022/2023 from 149 in 2021/2022 (18 less). That is the good news. The bad news is that late-term stillbirth abortions are up from 911 in 2021/2022 to 1,059 in 2022/2023 (148 more). And the worse news is, that these horrific abortions still happen at all.

That's a net 130 more late term abortions in 2022/2023 than in 2021/222.

All of these dead children are >= 20 weeks gestation

Seven of these children born alive after an abortion were 29+ weeks gestationNine of them were 25-28 weeks gestation when they died. 98 of them were 21-24 weeks gestation when they died. 

If someone had bothered to care for these children after their failed abortion, they could/would still be alive today.

RCMP must finally investigate born-alive abortions

Campaign Life Coalition is asking for the RCMP to open up an investigation into the tragedy of abortions that result in the live birth of a child. These children are born alive and left to die.

'Data from Statistics Canada and from the Canadian Institute for Health Information, a government-controlled reporting body, show that abortion attempts were made against the lives of these babies in regulated Canadian medical facilities. The data shows that these babies survived these assaults, that they were born alive, and then they died'


MP Maurice Vellacott also asked the RCMP look into this in 2013. At the time Commissioner Bob Paulson refused to investigate these deaths; it seems he allowed his pro-abortion ideaology to get in the way of impartiality:
"Your assertion that some, any or all of these occurrences constitute a crime requires an untenable contortion of the Criminal Code far removed from the legal consequences of the Morgentaler decision and the reality of a quarter century of deliberate Parliamentary inaction.'
Hopefully Commissioner Mike Duheme will do the right thing and finally investigate these horrific deaths.

This news might terrify you--but it must be told

I hope I do not ruin your weekend with the information I am about to divulge to you. This was not my intention. But you need to know. It is in regard to policies of the Conservative Party of Canada. It is quite distressing, but I think we all need to reflect on how this information could affect its citizens, should the Conservatives ever come to power.

These particulars have been shared by one of Canada's leading organizations. A group who specializes in telling us the truth about these matters. These people have never, ever, been involved in spreading misinformation or disinformation.

Here they have helpfully "paraphrased to make clear the intended or likely meaning" of these shocking Conservative policies that would harm our democracy:

• "Compelling universities to allow anti-choice expression and hate speech on campuses" (ImagineAllowing pro-life groups the right to their freedom of speech rights, on university campuses no less.)

"Allowing healthcare workers to refuse to participate in or refer patients for abortion or medical assistance in dying." (Imagine. Not forcing doctors and nurses to kill their patients.)

"Opposing the right to medical assistance in dying" (Imagine. Actually being against killing people.)

• "Prohibiting research using embryos" (Imagine. Being against using human embryos in research where these tiny humans can be dissected, discarded, or whatever else suits someone's purpose.)

"Excluding abortion from Canada’s maternal and child health programs abroad."  (Imagine. Being against killing other countries pre-born children.)

"Condemning sex-selection abortions." (Imagine. Being against the killing of pre-born children who are female.)

"Amending the human rights code to allow faith-based organizations to discriminate based on their beliefs" (Imagine. Allowing Canadian citizens to practice their freedom of religion rights.)

• "Changing the criteria for Canada Summer Jobs to make anti-choice groups eligible for funding again." (Imagine. Ceasing to discriminate against pro-life people and people of faith in receiving government grants.)

"Supporting legislation to grant fetal personhood by making it a separate crime to harm or kill a fetus during a crime against a pregnant person." (Imagine. Supporting the enactment of a separate crime when someone kills a wanted pre-born child.)

Supporting legislation to mandate “life-saving care” and “intensive care” for fetuses born alive after an abortion." (Imagine. Supporting the provision of actual care to a child born alive after an abortion.)

"Opposing the rights of sex workers and the decriminalization of prostitution." (Imagine. Declaring that "human beings are not objects to be enslaved, bought or sold.")

I hope I haven't unduly shocked you, but please please, take the time to reflect on how these policies would affect our dear Canada. We simply cannot, must not, let these policies ever see the light of day.

Correcting misinformation about abortions greater than 24 weeks gestation

I found this in Wikipedia on Abortion in Canada.
"The general rule is that few providers offer abortion care beyond 23 weeks and 6 days, but there can be exceptions in certain cases".

Unfortunately I couldn't access this paper, but I'd love to see information on these later than 24 week abortions. In fact why do they hide the info from the public?

Then we have this reference from Action Canada for Sexual Health and Rights, who, as we have seen before, states that abortions in Canada don't happen past 23 weeks and 6 days. 

  1.  "Access at a Glance: Abortion Services in Canada | Action Canada for Sexual Health and Rights". Action Canada for Sexual Health & Rights. While abortions after 20 weeks are statistically very rare (<0.5% to 2.5% of all abortions), there are people in Canada who require abortion beyond 20 weeks for serious medical reasons. There are only three service locations in Canada that offer abortion up to 23 weeks and 6 days (one in British Columbia, one in Southern Ontario, and one in Quebec). No providers in Canada offer abortion care beyond 23 weeks and 6 days.

Of course Canada does perform abortions past 24 weeks, some of which are born-alive abortions. As I have stated many times before, these are abortions that are greater than 20 weeks gestation and greater than 500 grams, where a child is born alive. 

There are two sources for this fact. One is Statistics Canada. The description for these abortions is 

"Cause of death (ICD-10: Termination of pregnancy, affecting fetus and newborn [P96.4]"

The second source is the Canadian Centre for Health Information ( see 2021-2022, 2020-2021, 2019-2020, 2018-2019, 2017-2018, 2016-2017, 2015-2016 below). 

"Newborns from Termination of Pregnancy are defined by: - entry_code = 'N' - P96.4 Termination of pregnancy, affecting fetus and newborn is captured as the MRDx, with Z38.- Liveborn infants according to place of birth, as diagnosis type (0)...Liveborn abstracts are not expected for gestational age < 20 weeks. Tables 2 and 3 only include livebirths with gestational age =>20 weeks." 

The numbers below detail these live-birth abortion from 20 weeks gestation onwards. Also included are the numbers of live-birth abortions greater than 24 weeks gestation. It is important to note that excluded from these totals are any late-term live-birth abortions from the province of Quebec, and only include hospital late-term live-birth abortions, but nor from clinic settings. Therefore the numbers would be higher than reported.

There are also documented numbers for still birth abortions > 20 weeks gestation, but these stillbirth abortions are not broken down further. Unfortunately,

2021-2022 (19 born-alive abortions greater than 24 weeks gestation)

2020-2021 (16 born-alive abortions greater than 24 weeks gestation)

2019-2020 (10 + born-alive abortions greater than 24 weeks gestation)

Canada continues to allow born alive aborted babies to die because too many people just don't care

Speaking of Canada's shameful practice of allowing aborted babies to die after being born, I did an ATIP to the RCMP regarding this story, that you may remember:

"On January 23, 2013, three Conservative MPs (Maurice Vellacott – Saskatoon-Wanuskewin, Wladyslaw Lizon – Mississauga-Cooksville, and Leon Benoit – Vegreville-Wainwright) wrote a letter to RCMP commissioner Bob Paulson calling for a criminal investigation into the deaths of 491 babies born alive after abortions but left to die. The deaths occurred between 2000 and 2009. Vellacott wrote a letter of clarification after the initial erroneous media coverage, saying “contrary to what some of the media have been reporting, my colleagues, Leon Benoit and Wladyslaw Lizon, and I did not ask the RCMP to investigate any/all abortions after 19 weeks as possible homicides.?? He explained, “our request to the RCMP was not about the deaths of preborn children, but rather the deaths of children who had already been born alive and who are, therefore, recognized as ‘human beings’ in Canadian law.??"

This is what I asked for:

"I would like to see all documentation (emails, letters, briefing notes, etc.) related to this request to the RCMP; that is, to and from the MPs and the RCMP. Also all documentation to and from the RCMP and any other government organization including the PMO, regarding this MP request for an investigation of possible homicides to the RCMP."

This is what I received back. Other than Maurice Vellacott's own letters, there are only two letters from Commissioner Bob Paulson to Mr. Vellacott. No other documentation of any kind to show that the commissioner did anything with the complaint.

A couple of points to note:

First, the Commissioner never acknowledged Mr. Vellacott's letter because he thought the "RCMP's public acknowledgement...was sufficient to confirm reception". Perhaps an actual response letter to Mr. Vellacott would have been in order? It's called common courtesy.

Second, the Commissioner summarily dismissed Mr. Vellacott's complaint of possible criminal behaviour regarding these born alive abortions. Without any reason, and without any investigation on the very serious allegations. Even when Mr. Vellacott details the pertinent criminal code section, which at the very least should give someone pause:

 (1) A child becomes a human being within the meaning of this Act when it has completely proceeded, in a living state, from the body of its mother, whether or not

    • (a) it has breathed;

    • (b) it has an independent circulation; or

    • (c) the navel string is severed.

  • Marginal note:Killing child

    (2) A person commits homicide when he causes injury to a child before or during its birth as a result of which the child dies after becoming a human being.


Third, the second letter from the Commissioner. In this one, his disdain for these allegations is clear:
"The Statistics Canada figures you reference in your correspondence purportedly represent occurrences recorded in regulated medical facilities involving medical practitioners, who must abide by their professional obligations..."

Fourth, the commissioner's using the word purportedly shows that he didn't even bother to reach out to Stats Canada. Otherwise he would have learned that yes indeed, these are late term abortions where a child dies after it is born. It is not purportedly at all. Does he not trust Stats Canada?

Fifth, just because these abortions happen in regulated facilities, does that mean that we don't investigate possible occurrences of criminal behaviours? Think of Kermit Gosnell, the master of botched abortions.

Sixth, "Your assertion that some, any or all of these occurrences constitute a crime requires an untenable contortion of the Criminal Code..." How could it be an untenable contortion if you didn't investigate? The Commissioner's pro-abortion bias just oozes out from his choice of language.

Seventh, it is bizarre that Mr. Paulson was provided with both the data of the possible crimes and the Criminal Code citation, and then evasively indicates that the public is supposed to do his investigation for him.

Of course, we all know there is one set of rules for pro-life people, and one set of rules for pro-abortion people. Commissioner Paulson, on his own, without any investigation whatsoever into these very serious allegations, decided they had no merit.




Some might think this is all water under the bridge now because this happened ten years ago. But it isn't. These helpless little infants continue to be born alive after an abortion, and continue to die. And because of Canada's unrelenting pro-abortion ideology, we will continue to do nothing to stop it.

Canada has 22 more late-term born-alive abortions than last year

Last year there were 127 live-birth abortions. This year there were 149. That's an increase of 22 babies born alive after a late term abortion.

Six of these babies were greater than 29 weeks gestation.

There were also 911 late-term stillbirth abortions (Greater than 20 weeks gestation).

These numbers exclude Quebec born alive abortions. I'm not sure if I noticed this before.

Canada does late-term abortions - don't let the pro-aborts tell you it doesn't happen

The lie

"No providers in Canada offer abortion care beyond 23 weeks and 6 days. When they are beyond 23 weeks and 6 days, many Canadians end up having to travel to the United States to access services with little guidance or support from their governments."

Regarding the grim case of a recent 38 week old fetus being aborted in particular, I received this question from someone:

"I was led to believe in the past that 3rd trimester abortions for Canadian Women were actually done in the US as their weren’t doctors to do them in Canada. Is that correct? Also was this one done in Montreal a first in Canada? Really having a hard time getting my head around this."

The short answer is: 

  • Canada does send women to the US for abortions
  • the very late term abortion in Montreal was not a first for Canada
  • every year there are many late-term abortions done in Canada
  • and please note that all these abortions detailed below result in a live child who is left to die, they also just happen to be late-term abortions

The problem is that the pro-aborts would have us believe that these horrific abortions are rare. They are not.

Below is what we know for sure, but as always, there is a lot of data missing from this. All this information below comes from the Canadian Institute for Health Information (CIHI). So please don't shoot the messenger.

NOTE: There are also stillborn abortions listed in the links below. Because gestational ages are not provided for stillborn abortions, I am not including them in my calculations below, except to identify their numbers. All of these stillborn abortions reported by CIHI are > 20 weeks gestation. Therefore, there would definitely be late-term abortions in these numbers, we just don't know how many.

Born alive abortions

NOTE this from CIHI:

"in accordance with CIHI’s privacy policy, cells with counts of 1 to 4 are suppressed. These are represented by N/R (Not reportable) in the table. Suppressed cells are excluded from the totals."

What this means is, that when you see a cell containing N/R, there are 1 to 4 of these abortions for that gestational age.

In 2020/2021 there were 8 born alive abortions 29 + weeks, and 8 between 25 and 28 weeks.

There were also 935 stillborn abortions done this year, all > 20 weeks gestation. Some of these would be late-term abortions.

In 2019/2020 there were 10 born alive abortions performed 25-28 week gestation, and 1-4, 29 + weeks

There were also 999 stillborn abortions done this year, all > 20 weeks gestation. Some of these would be late-term abortions.


In 2018-2019 there were 5 born alive abortions done 29 + weeks, and 15 done 25 -28 weeks

There were also 902 stillborn abortions done this year, all > 20 weeks gestation. Some of these would be late-term abortions.


In 2013-2018 there were 8 plus an unknown number of born alive abortions done of 29 + weeks, and there were 27 done 25 - 28 weeks.

There were also 4,282 stillborn abortions done this year, all > 20 weeks gestation. Some of these would be late-term abortions.

National Abortion Federation never reported Kermit Gosnell's clinic and now receives Canadian tax dollars

This story is frightening: Kermit Gosnell killed women and children. Ann McElhinney did a six part podcast on this real life horror story.

Kermit Gosnell was a serial killer, a major drug dealer, a fraudster, a liar and who knows what else. Not only did he kill women and snip the necks of born children, he taught his non-medical staff to provide copious amounts of drugs to women (illegally) before their abortions. He also taught them how to kill the babies. His staff would do this when Gosnell wasn't present, as he usually didn't come to work until the evening. That's when Gosnell did the very late abortions himself.

Here is the grand jury report on this story, 281 pages detailing all manner of evil.

The report details how numerous agencies and health professionals ignored/did nothing regarding this house of horrors when they should have. In particular:

  • Department of Health lawyers at the Pennsylvania Department of State
  • The Philadelphia Department of Public Health
  • Hospital of the University of Pennsylvania and its subsidiary, Penn Presbyterian Medical Center
  • Centers for Disease Control
  • Fellow doctors
  • The National Abortion Federation
A few quotes from the report:
"We discovered that Pennsylvania’s Department of Health has deliberately chosen not to enforce laws that should afford patients at abortion clinics the same safeguards and assurances of quality health care as patients of other medical service providers. Even nail salons in Pennsylvania are monitored more closely for client safety... Most appalling of all, the Department of Health’s 138 neglect of abortion patients’ safety and of Pennsylvania laws is clearly not inadvertent: It is by design."

"The problem with the Departments of State and Health is not that they lacked authority to end the crime spree that Gosnell and his staff passed off as practicing medicine. The problem is that the state overseers preferred not to exercise their authority. They chose to look the other way.'"

"Supervisors in the Division of Disease Control ignored a nurse’s disturbing report about conditions in Gosnell’s clinic in 2008 and 2009." 

"The Philadelphia Health Department’s Environmental Engineering Section failed to follow through after receiving a complaint in 2003 about aborted fetuses stored in an employee refrigerator."

"FELLOW DOCTORS WHO OBSERVED THE RESULTS OF GOSNELL’S RECKLESS AND CRIMINAL PRACTICES FAILED TO REPORT HIM TO AUTHORITIES."

"After reviewing extensive and compelling evidence of criminal wrongdoing at the clinic, the Grand Jury has issued a presentment recommending the prosecution of Gosnell and members of his staff for criminal offenses including: • Murder of Karnamaya Mongar • Murders of babies born alive • Infanticide • Violations of the Controlled Substances Act • Hindering, Obstruction, and Tampering • Perjury • Illegal late-term abortions • Violations of the Abortion Control Act • Violations of the Controlled Substances Act • Abuse of Corpse • Theft by Deception • Conspiracy • Corrupt Organization • Corruption of Minors"

 Canadians should take particular note of the National Abortion Federation:

"A national association of abortion providers declined to admit the Women’s Medical Society [Kermit Gosnell's abortion clinic] as a member, finding it to be the worst facility its inspector had ever seen...the evaluator from NAF readily noted that records were not properly kept, that risks were not explained, that patients were not monitored, that equipment was not available, that anesthesia was misused. It was the worst abortion clinic she had ever inspected. Of course, she rejected Gosnell’s application. She just never told anyone in authority about all the horrible, dangerous things she had seen." (emphasis added)

In fact NAF supposedly:

"is an association of abortion providers that upholds the strictest health and legal standards for its members." (emphasis added)

Yet the NAF inspector didn't tell anyone about the problems she witnessed there.

And guess what? This year Health Canada gave funding to NAF Canada (NAF is now active here) in the amount of $1,469,150Even though their inspector witnessed first hand problems with Gosnell's clinic, they never reported it to anyone. They just turned a blind eye. And now Canada is giving them our tax dollars.

I don't know about you, but I find this fact pretty disturbing.

Live-birth late-term abortions still happen in Canada

There are some who say Canada does not perform late-term abortions. They are disinformation abortion lobbyists. (AKA Action Canada for Sexual Health and Rights)

"No providers in Canada offer abortion care beyond 23 weeks and 6 days. When they are beyond 23 weeks and 6 days, many Canadians end up having to travel to the United States to access services with little guidance or support from their governments."

According to CIHI, here are the 2020-2021 numbers. These abortions are not only late-term abortions, they are also born-alive abortions.

In 2020/2021 Canadian abortion doctors performed:

18 of these horrific abortions at 20 weeks gestation

93 of these horrific abortions from 21-24 weeks gestation

8 of these horrific abortions from 25-28 weeks gestation

8 of these horrific abortions 29 weeks gestation and older

That's 127 born alive abortions in one year. That's 15 more than there were in 2019/2020

To add to this horror, there were 935 stillbirth abortions performed of 20 weeks and later gestation.

If this isn't something to weep over I don't know what is.

Ten 25-28 week gestation live birth abortions is not none

Action Canada claims:

"No providers in Canada offer abortion care beyond 23 weeks and 6 days. When they are beyond 23 weeks and 6 days, many Canadians end up having to travel to the United States to access services with little guidance or support from their governments."

Not true. In fact in 2019-2020, there were 84 live birth abortions of 21-24 week gestation, and 10 live birth abortions of 25-28 week gestation in Canada. That is not none. And it is for one year only. And these numbers do not include Quebec abortions. These are abortions that fail, resulting in a live human being being born. And left to die. That is something. And we should all be ashamed.

Statistics Canada VS CIHI late-term abortions

Melissa asked

"How come the CIHI doesn't report statistics for Quebec? If Ontario has 74 abortions resulting in live births, Quebec is bound to have a few as well."
CIHI's response:

"The official source of abortion data from Québec is provided to CIHI in the form of an annual file containing aggregated data. This file does not contain the information you are requesting. Available abortion-related data for Québec is published in our annual induced abortion tables here: https://www.cihi.ca/sites/default/files/document/induced-abortions-reported-in-canada-in-2019-en.xlsx" (we already know this)

I also asked them another questions:

"On your quick stats for the country, gestational age abortions are also excluded for Quebec. Why? And why do you not report gestational ages of abortions done at clinics?"

Here is CIHI's response:

"Clinic data is provided to CIHI on a voluntary basis, and does not include volume breakdowns by gestational age."

More gruesome numbers of late-term deaths (>=20 weeks gestation) of pre-born children.

CIHI's numbers for 2019-2020 stillbirth abortions, and livebirth abortions in Canada.

CIHI reports 999 deaths by abortion of children in the womb that resulted in stillbirths in 2019-2020.

CIHI reports 112 deaths by abortion of children in the womb that resulted in livebirths in 2019-2020.

Statistics Canada reports "Termination of pregnancy affecting fetus and newborn [Code P9.64]" 69 deaths. Notice that Statistics Canada uses the term "newborn". That is because of course, once a baby is born alive, it is considered a person.

Once again CIHI's numbers are different than Statistics Canada's.

502 Livebirth abortions in Canada from 2014 to 2018

Live birth abortions from Statistics Canada: Termination of pregnancy, affecting fetus and newborn [P96.4]

I've reported on these Stats Canada's livebirth abortions, and CIHI's livebirth abortions, many times before.

Stats Canada's and CIHI's livebirth abortion numbers are never the same. I've never been able to get an answer as to why their numbers are always different.

We still don't know why these late term abortions are born alive. We still don't know what happens to these little souls when it happens. We do know that they died because they are reported as a death by Stats Canada. Are these tiny humans held and comforted as they wait to die? Are they thrown into the garbage? How much do they suffer? Did anyone ask them what they wanted?

These livebirth abortions are shameful. They are a tragedy. And they continue to happen year after year.

Stupid questions from pro-abortion people

From time to time I get really stupid questions about my late term born alive abortion statistics. These abortions are all done after 20 weeks gestation.

The child is born after an abortion, is a alive, and then it dies. That's all we know.

These morons make a comment or ask a question, I respond, and then they come back with really dumb comments like "I'm not going to read your blog" or "I can read" or "there's no such thing as late term abortions".

These are not my numbers. I didn't make them up. They come from the Canadian Institute for Health Information. If you don't like them it's not my fault, you imbecile. CIHI gets them from hospital discharge records. If you don't like the numbers, then stop believing it's A-okay to keep killing these babies by abortion, any abortion. Before or after 20 weeks.

If you want to have a grown up conversation about these horrific killings of fully formed and often viable human beings left to die, I'm happy to do that. 

But if I see one more stupid comment you're blocked. And have a nice day and give your stupid brain a rest. It needs it.

Late-term stillbirth (902) and livebirth (150) abortions in 2018/2019

Live birth abortions continue to happen in Canada.

Here are the latest numbers of late term abortions in Canada from CIHI. There were 910 late-term (20 weeks and greater) stillbirths and 150 born alive abortions.

Previous years here.

20 of these born alive abortions were greater than 25 weeks gestation.
107 of these born alive abortions were between 21 – 24 weeks gestation.
23 of these born alive abortions were 20 weeks gestation.

Note: These are for hospital abortions only and do not include clinics or physician's offices. These numbers also do not include late-term abortions done in Quebec.

Canada: why did 766 late-term livebirth abortions happen?

This is extremely depressing.

According to new data, livebirth late-term abortions are still happening in Canada. And the numbers are way too high.

According to CIHI, There were 766 late-term livebirth abortions in a five year period from 2013/2014 to 2017/2018. These numbers are even higher since they exclude Quebec.

There has been much speculation about the reasons for these late-term livebirth abortions (P96.4 Termination of pregnancy) but we have no hard data on why they happen since the reasons or circumstances aren't published with the data.

A study was done in Quebec in 2016. That study:
"found the number of infants who were born alive and died after an abortion jumped from one per 100,000 in 1986-1999, to 19.4 per 100,000 between 2000 and 2012. Those accidental live births totalled 218 babies."
The study's author asked these sobering questions:
“How are such infants cared for?” they ask in the journal Neonatology. “If not resuscitated, is palliative care provided? Are the infants admitted to neonatal units or do they die in the delivery room?”
All information regarding the reasons they happen, and what happens to the child after they are born alive, is anecdotal.

But they do happen. This we know for a fact and we know the numbers: 766 late-term livebirth abortions in a five years period.

Ireland worries about Canada's born alive abortions

Remember the 491 born alive abortions in Canada in for 2000 to 2009?

Well Ireland has picked up on this worrisome fact and has some worries of their own:
"Concerns were raised to the Canadian prime minister, Justin Trudeau, over claims made in the Oireachtas..." 
"Abortion is not criminalised in Canada and is governed under the same laws as other health procedures. Anti-abortion campaigners in Ireland have claimed that the liberal law has led to terminations where the foetus was still alive after the procedure."
Rónán Mullen, the independent senator, claimed on the record of the joint Oireachtas committee considering repeal and replacement of the Eighth Amendment that in Canada “botched abortions have taken place in recent years and where children were alive after the procedure”. 
Mattie McGrath, the independent TD, has made similar claims and Cora Sherlock, a spokeswoman for the Pro Life Campaign, has said that there were more than 400 babies in the last ten years “born alive in botched abortions and left to die alone” in Canada. "
SOGC was not able to respond to the allegations:
“The SOGC is not aware of cases where there is evidence of any dereliction of duty, and therefore we are not able to respond to the allegations that you refer to in your email,” he said." 
And Stats Canada could not "support or refute" Ireland's concerns about these born alive abortions:
“There is nothing in the data that would support or refute the characterisation of these events as ‘botched abortions’ or the assertion that these infants were ‘left to die alone in hospital corners’,” Statistics Canada said in a letter.
(Note that for the 10 years 2000 to 2009 there was an average of 49 born alive abortions per year. The latest numbers are an average of 73 per year or a 50 % increase in born alive abortions. See below.)

Here is an update on Canada's born alive abortions. These abortions are coded P96.4, "Termination of pregnancy, affecting fetus and newborn".

1) After you go to the link above, click on "Add/Remove data".

2) Go to "Step 4 - Select: Cause of death" and click on "All" twice (the first click all causes of death to be ticked, and the second click removes all causes). Then scroll down towards the bottom and click only on "Termination of pregnancy, affecting fetus and newborn [P96.4]"

3) Then go to "Step 5 - Select the time frame" and choose from 2009 to 2013.

Between 2009 and 2013 there were 366 born alive abortions in Canada or an average of 73 born alive abortions per year:

(UPDATE: I realized that I included 2009 in both calculations. If we ignore 2009 in this most recent calculation, it would be a total of 299 for four years for an average of  74.75 born alive abortions per year)

How the defeat of Cassie and Molly’s Law could endanger abortion

Cathay Wagantall’s Private Members Bill C-225 (Cassie and Molly’s Law) was defeatedby a wide margin (209 to 76) in the House of Commons last week. This means the bill will not be sent to a committee for study and is now dead.

Bill C-225 would have allowed charges to be laid for harming or causing the death of a preborn child while committing a criminal offence against a pregnant woman. Such a law would act as a strong deterrent to committing violent acts against pregnant women, increasing the chances she and her baby could make it safely through her pregnancy. It was a compassionate and common sense response to an all too common problem.

Not a single MP from any party other than the Conservatives voted for the bill. This suggests the vote may have been whipped by leaders of the Liberals, the NDP, and the Bloc, which is odd since Prime Minister Justin Trudeau and the other party leaders have repeatedly argued in favour of women’s reproductive choice. Bill C-225 would have strengthened reproductive choice for women by making it a criminal offence for a third party to intentionally kill a pregnant woman’s fetus (thus terminating her pregnancy) while committing a criminal offence against her – a pregnancy termination to which she clearly did not consent. We are talking here about someone who attacks a woman and takes away her choice by ending the life of the child who otherwise would have been born alive. Nothing could undermine women’s reproductive choice more than that.

My MP, Chandra Arya (Liberal) wrote to me last month saying that he would not be supporting the bill. I had seen comments from other Liberal MPs as well. No doubt, the Liberal MPs were given a set of talking points to use to try to defend their opposition to C-225. But their arguments don’t stand up to scrutiny, which suggests something else was behind their opposition to the bill, as I explain below.

Criticism: C-225 doesn’t address the broader issue of gender-based violence

The Liberal government criticized the bill for failing “to address the broader issue of violence against women.” But why would any MP not support a law that at least partially addresses the problem? No bill ever completely addresses an issue, and so why should C-225 be held to a higher standard than any other bill?

Mr. Arya also told me that “Our government believes that gender-based violence has no place in our society, and we are committed to developing and implementing a comprehensive federal strategy against gender-based violence.” That’s great, and bill C-225 could have been one important part of such a comprehensive strategy. Voting for this bill in no way would have precluded the government from enacting further laws and policies that address gender-based violence. Pregnant women are sometimes attacked precisely because they are pregnant. Cassie and Molly’s Law would act to deter such violence, given the stiff penalties in the bill for purposely causing the death of the woman’s unborn child.

Criticism: C-225 might be challenged under the Charter

My MP also told me the bill “would likely be challenged under the Charter.” Yet, as far as I’m aware, there has been no credible legal opinion by any reputable lawyer arguing that the bill violates the Charter. On the contrary, renowned constitutional expert Eugene Meehan has provided a legal opinion, posted on Cathay Wagantall’s website, defending the constitutionality of the new offences created in the bill.

Most Liberal MPs voted in favour of the government’s bill C-14, Medical Assistance in Dying, even though several lawyers were of the opinion it was unconstitutional. So if the Liberal MPs were not deterred by the constitutional concerns regarding C-14, it is incredible that constitutional concerns were behind their opposition to Cassie and Molly’s Law.

What was the real reason for opposing C-225?

Given C-225 respects the constitution, including the Charter; given it is one concrete way that MPs can help tackle gender-based violence which they claim they want to do; and given it is supported by amajority of Canadians, it seems that MPs’ opposition to this bill stemmed from something else – something they may not have been even consciously aware of.

Which brings us to the issue of abortion.

Fear that C-225 could reopen the abortion debate

My MP told me that this bill could “reopen the abortion debate.” This bill and the abortion issue do have something in common – they both deal with pregnant women and preborn children. But anyone who is truly pro-choice ought to recognize the difference between an abortion which a woman freely chooses, and a situation where a woman has not chosen abortion and is violently attacked by a third-party who wants to kill her and/or her baby and unilaterally takes away her choice to bring her child safely to term.

So how do we account for supposedly pro-choice MPs voting against a bill that would have made it a crime to forcefully end a woman’s pregnancy against her will? Why did these MPs ignore the significant role that the woman’s free choice plays in differentiating C-225 from abortion? Are these MPs not pro-choice after all, but rather pro-abortion, even pro-forced abortion?

I don’t believe so – I don’t believe a majority of our MPs voted against C-225 because they actually believe that a dead fetus is better than a live fetus.

The only remaining explanation is that they voted against C-225 out of fear of what it would mean for abortion if we recognized in law that it can sometimes be wrong to kill a preborn child. They would have been asking themselves, even if only at an unconscious level: if it is wrong to kill a fetus during a brutal attack on a woman against her will, how can we justify abortion, which also kills a fetus?

But as MikeSchouten writing in the National Post points out, there would be no reason for anyone who is pro-choice to fear that C-225 would endanger abortion if they actually believed in their own pro-choice rhetoric: that a woman’s freedom to choose is enough to justify abortion (that is, that the choice of the woman trumps the life of the fetus.)

The defeat of C-225 was in essence, then, a sign that a majority of our MPs do not believe that freedom of choice, in and of itself, can justify abortion. A majority of our MPs could not get past focusing on how C-225 and abortion are alike (preborn child’s death), rather than how they differ (woman’s choice). It was apparently easier for our MPs to deny that it can ever be wrong to kill a fetus – and vote against C-225 – than to be put into the uncomfortable position of having to justify why abortion is not wrong. They are apparently only able to defend abortion if they deny there is any inherent value in the life of a preborn child. They would have had the confidence to defend abortion if they truly believed deep down that the choice of the woman trumps the life of the fetus.

Thus in defeating C-225 for fear it could endanger abortion, our Members of Parliament ended up revealing a lack of confidence in their own ability to defend abortion. If even our supposedly staunch “pro-choice” MPs feel so ill-quipped to defend abortion, then what kind of message does that send about the acceptability of abortion? C-225 itself could never have endangered abortion. The irony is the MPs who opposed the bill might end up doing just that.
